PRIVACY MATTERS

Data provided by anyone registering as a Member of Ericsson Developer Connection is stored in Ericsson's database and it may be accessed from all around the world by different companies and units within the Ericsson Group as well as different units within the Sony Ericsson Mobile Communications Group.

Data provided by a Member is used by the Ericsson Group and the Sony Ericsson Mobile Communications Group to send information requested by the Member, send offers to the Member as well as for statistics, market analysis and related matters.

The Ericsson Group may use cookies to identify repeated visits of a Member to the website, and to determine the path taken by a Member on the website.

A Member's contribution on these websites will be accessible also by others than the Member and Ericsson.

A Member may not use information about third parties to send unsolicited advertisment to such third parties, nor may a Member collect or store personal data about other Members or visitors of this website.

Ericsson does not transfer your personal information to others except as set out in these terms and conditions.

VALIDATION OF CREDIT CARDS
Ericsson may disclose your data to credit card companies, including banks, for validation reasons if your credit card is used for payments of products and services ordered through Ericsson Developer Connection.

USER ID AND PASSWORD
The user id and password of a Member are for use by the Member alone and a Member shall exercise reasonable care in their safeguarding to prevent access by any other party to the web pages open for members only.

INTELLECTUAL PROPERTY RIGHTS OF THE ERICSSON GROUP
Ericsson agrees that the information and material provided by Ericsson on or through its Ericsson Developer Connection website may be viewed, copied, printed and used by the Member for its intended purpose but it may not be displayed on a public internet site nor may it in any other way be distributed to others. Software provided by Ericsson on this website may only be used on the license conditions set out for such software.

However, products, processes and technology described herein may be subject of patents, design, utility models or trademark rights owned by Telefonaktiebolaget LM Ericsson or any other company and no right to use such Intellectual Property is granted hereunder.

THIRD PARTY TERMS AND CONDITIONS

Ericsson Developer Connection websites may include links to Sony Ericsson Mobile Communications websites as well as other third party sites. Such websites may have their own terms and conditions, which a Member must adhere to. This Agreement between the Member and Ericsson does not constitute an agreement between a Member and a third party.

As an example only, it may be possible to access support offered by Sony Ericsson Mobile Communications through this website and such support are subject to separate terms and conditions.

MEMBER CONTRIBUTIONS
It is the responsibility of the Member to assure that

a) Member contributions do not include any defamatory, racist, pornographic, unlawful or unethical material. Read more Ericssons Code of Business Ethics

b) no Member contributed material (including viruses) which could harm Ericsson, its partners, other Members or any other party, are knowingly or recklessly spread to our through the Ericsson Developer Connection websites

c) all consents required for Member's contribution on Ericsson Developer Connection websites of any party's trademarks, copyright protected works, know-how and trade secrets or other proprietary rights are properly obtained

d) no false identity and no other misleading information is placed on the website by the Member

Ericsson will not generally examine contributions made but Ericsson reserves the right to remove any Member contribution at any time, whenever Ericsson deems appropriate due to legal, security, policy or other reasons.

Any contributions by a Member will be treated as non-confidential and non-proprietary and Ericsson will have no obligation to keep contributions confidential.

NO WARRANTIES
The Ericsson Developer Connection website is provided as a convenience to you and Ericsson does not warrant uninterrupted or error-free access. Ericsson reserves the right to close down the site, wholly or partly.

ANY SUPPORT, INFORMATION AND DOCUMENTATION PROVIDED UNDER ERICSSON DEVELOPER CONNECTION, WHETHER ON INTERNET, BY E-MAIL OR IN ANY OTHER WAY, ARE PROVIDED ON AN "AS IS" BASIS AND WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESSOR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. TECHNICAL INACCURACIES OR OTHER ERRORS MAY OCCUR AND CHANGES MAY BE DONE IN ANY INFORMATION/DOCUMENTATION AT ANY TIME WITHOUT NOTICE.

IN NO EVENT SHALL ERICSSON BE LIABLE TO COMPENSATE A MEMBER FOR HAVING USED OR RELIED ON THE SUPPORT/INFORMATION/DOCUMENTATION PROVIDED UNDER THIS AGREEMENT AND ON THE WEBSITES REFERRED TO HEREIN.

ERICSSON IS FURTHER EXCLUDED FROM ALL LIABILITY OF ANY KIND ARISING FROM CONTRIBUTIONS MADE BY ANY MEMBER OR THIRD PARTY.

ERICSSON DOES NOT WARRANT A MEMBER'S ACCESSABILITY TO THE WEB PAGES AT ANY TIME.

RELATION BETWEEN THESE TERMS AND CONDITIONS AND GENERAL LEGAL AND PRIVACY STATEMENTS
In case of discrepancy between these Terms and Conditions and the general statements at the bottom of the website, these specific Terms and Conditions shall apply between Ericsson and a Member.

TERMINATION
This Agreement shall continue until terminated by either party as set out below.

A Member can terminate the Agreement through prior written notice at any time. Upon such Member termination the Member may not benefit from the websites and services that are for Members only. Ericsson may elect to terminate the Ericsson Developer Connection websites, wholly or partly at any time without notice. In case of termination of the whole Web sites this Agreement is terminated forthwith.

If Ericsson identifies any contribution of a Member that Ericsson believes to be illegal, unethical or contrary to security rules or other policies of Ericsson, Ericsson may terminate a Member's membership forthwith and such termination includes termination of this Agreement.

CHANGES TO THIS AGREEMENT
ERICSSON RESERVES THE RIGHT TO CHANGE THIS AGREEMENT AT ANY TIME. SUCH CHANGES SHALL BE NOTIFIED TO THE MEMBER ON THE ERICSSON DEVELOPER CONNECTION WEBSITE AND SHALL BE DEEMED TO HAVE BEEN ACCEPTED BY THE MEMBER IF THE MEMBER CONTINUES TO USE THE WEB SITE AFTER A PERIOD OF TWO WEEKS FROM THE DATE OF NOTICE.

ASSIGNMENT
Should Ericsson wish to transfer activities of Ericsson Developer Connection to another party Ericsson reserves the right to transfer Ericsson's rights and obligations under these terms and conditions to such party as well as to transfer the Member data to the same party.

GOVERNING LAW
This Agreement and the services provided by Ericsson hereunder are governed by and construed in accordance with the laws of Sweden.
