Introduction

This Privacy Notice explains who we are, how we collect, share, and use your personal data, and how you can exercise your privacy rights. When we refer to “personal data” we mean any information relating to an identified or identifiable individual.

Data Controller

This Privacy Notice applies to situations where Ericsson Group companies act as data controllers or equivalent local law concepts.  The personal data is being collected by the Controller, a local Ericsson company and/or Ericsson AB, 556056-6258, 164 80 Stockholm, Sweden. The relevant local Ericsson legal entity for the talent acquisition, talent management and/or Ericsson AB shall be considered controller or joint controllers for the processing of personal data.

Why we process your personal data

The Ericsson Careers Site is a cloud-based applicant tracking system. Ericsson uses this application globally to manage its recruitment activities. Candidate profiles and job applications including any personal data may be used to pre-screen the candidate for a specific open position, and/or for other job opportunities. To help compare profiles with job opportunities, Ericsson uses a matching algorithm that assesses skills and experience against the job criteria.  There is no automated decision making, the application uses AI to facilitate matching, profiling, and rating/ranking the candidate to jobs. The algorithm will provide recommendations based on skills match, location years of experience, and job roles, and a recruiter or a hiring manager can assess all applications to make any decisions related to the hiring process. We may also process the candidate’s personal data to comply with legal requirements. Background checks are performed for positions, but only for candidates who have reached the final stages of the recruitment process.

Following the candidate's consent to the Privacy Notice, they are automatically enrolled in the Ericsson talent network and may, therefore, be added by a recruiter as potential candidates for future or current roles. Upon enrolment, candidates are sent an email with details of how to opt-out should they not wish to be a part of the search for future opportunities. We only use your personal data where necessary for the purposes specified below.

The personal data processing is necessary for the implementation of pre-contractual measures and the decision on the establishment of an employment relationship (Article 6(1)(b) General Data Protection Regulation, GDPR). This applies to the review of selected candidate profiles, job applications, interview notes as well as to onboarding activities for candidates that have signed employment contracts. Art. 6 (1) (b) GDPR in conjunction with § 26 (1) BDSG (Federal Privacy Law) following application based on consent Art. 6 (1) (a).

Personal data we collect:

The data processed may include address, email, other contact details, education, competencies, skills, work experience and nationality as well as any additional information provided by you, for example in a CV or cover letter. This may also include information from publicly available sources (e.g., information collected from LinkedIn, if you have opted to be visible to employers and recruiters). Ericsson will also process information related to references and assessments.

Identity Data includes user ID, application ID, email address, first name, last name, resume, cover letter (if provided), gender, disability, and Citizenship.

Contact Data includes your personal email address, Personal phone number, resume, address,

Engagement Data includes your preferences, interests, possible opportunities comments, and feedback on surveys submitted

Sharing your personal data

Personal data may be shared with the Ericsson People Function (HR) representatives, other functions within Ericsson as well as with third parties involved in the recruitment process to assess whether your profile fits with current, or future job postings. The information you provide on an application in connection with a specific job posting may also be viewed together with additional data collected during the recruitment process (e.g., information obtained from interviews, and assessments) by the hiring manager.

International data transfers

The platform will reside in the EU and no transfers will be made outside of this jurisdiction. However, since Ericsson is present around the globe, personal data will be transferred across international borders to Ericsson entities in other countries. The countries where your personal data is transferred may not have similar data protection laws. However, Ericsson will protect your personal data as described in this Notice.

We may transfer your personal data from the EEA to countries/sectors which the European Commission has found to provide an adequate level of data protection in accordance with the GDPR. Information on countries that have been granted with an adequacy decision is available here.

We may transfer your personal data from the UK to the countries and territories covered by the UK adequacy regulations. Information on countries covered by the UK Adequacy regulations is available here; and

We may rely on our Binding Corporate Rules approved by the European data protection authorities in accordance with the GDPR to transfer personal data intra-group. A copy of our Binding Corporate Rules is available here; and

We may rely on all modules of the EU Commission’s Standard Contractual Clauses available here or other appropriate safeguards under the GDPR as well as the UK Addendums to the EU Standard Contractual Clauses and other appropriate safeguards under the UK data protection law.

How long will we keep your data?

Ericsson retains personal data for no longer than necessary for the purposes for which it is intended on the legal basis for the processing. Ericsson assesses the purpose for which the data is processed and limits this to a proportionate period during which the personal data is required. Inactive candidate profiles will be erased automatically after 12 months (6 months for Germany, Pakistan, Poland, Switzerland, and the United Kingdom). Job applications will be retained for as long as legally required and for as long as candidates can contest hiring decisions. Uploaded CVs for use in the matching functionality will be purged after 24 hours if candidate does not apply for a job.

Profiling

We use the information in an individual's application and their CV to assess their suitability for the position being hired. Through a series of interviews and assessments an applicant is either rejected for the position, an offer is extended, or they are contacted for an alternative role within Ericsson.

Your Data Subject Rights and How to Exercise Them

You have rights relating to the personal data we hold about you, however, they may be subject to various exceptions and limitations.

Right to access your personal data. You have the right to obtain confirmation on whether Ericsson processes personal data about you and receive a copy of such data as well as information on how we process your personal data.

Right to rectification. You have the right to rectify any inaccurate personal data we process about you or have any incomplete personal data about you completed.

Right to erasure. You have the right to have your personal data deleted, if (i) the personal data has been unlawfully processed; (ii) we no longer need such data for the purposes of the processing; or (iii) the processing is based on consent and you withdraw your consent, and we have no other legal basis for processing the data. However, Ericsson will not delete your personal data if Ericsson has a legal obligation to retain the data, the personal data is still necessary for the purposes of processing, or if Ericsson’s legitimate interests override your interests.

Right to data portability. You have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used, and machine-readable format, and you may have that data ported directly to another controller, where such personal data is processed based on your consent or to perform a contract with you.

Right to restriction. You have the right to restrict our processing of your personal data where you believe that the personal data we process is inaccurate or our processing is unlawful. You may also restrict our processing if Ericsson no longer needs the personal data, but you want us to store the data for the establishment, exercise, or defense of legal claims. You may also require us to restrict the processing of your personal data for the period when we assess your right to object to the processing of your personal data.

Right to object. You have the right to object to our processing of your personal data when we rely on our legitimate interests or those of a third party or if we in an exceptional case perform tasks in the public interest. If you object to our processing, we will cease processing your personal data and erase the data, unless we can demonstrate compelling legitimate grounds for the processing overriding your interests, or if the data is needed for the establishment, exercise, or defence of legal claims. You always have the right to opt out of receiving direct marketing from us.

Right to information. You have the right to receive transparent information about how we process your personal data.

Right to withdraw your consent. You have the right to withdraw any consent for processing you provided at any given time. You can withdraw your consent for cookies here. You can withdraw your consent for direct marketing by unsubscribing from receiving our direct marketing. Withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal.

By accepting and clicking the check box and acknowledging this Privacy Notice, you consent to the use of AI Ranking of your candidate profile as described and detailed in the Privacy Notice. Your consent obtained will be recorded accordingly. You have the right to revoke your consent at any time, you can do this by requesting to withdraw your consent to privacy-gfpl@ericsson.com. Ericsson will no longer be able to consider your application and your documentation on file and your candidate profile will be deleted from our systems immediately, please note this can take up to 48 hours from the time your request to revoke was submitted. The lawfulness of the data processing prior to the revocation of the consent will not be affected. Please note if you do not consent to the above terms your application cannot be processed.
