Notice to residents in Mainland China (“Notice”)

This notice applies to residents in Mainland China and to processing of personal information originally collected through our operations in Mainland China. This section should be read together with the main Privacy Notice. If this Notice conflicts with the main Privacy Notice, this Notice shall prevail within its scope.

For the purposes of this Notice, "personal data" means "personal information" as defined under China’s Personal Information Protection Law (“PIPL”): any kind of information recorded by electronic or other means that relates to identified or identifiable natural persons, excluding anonymized information.

“Sensitive personal data”, for purposes of this Notice and in accordance with the PIPL, means personal information that, if leaked or illegally used, is likely to cause harm to the dignity of natural persons or serious harm to personal safety or property security. Examples include information about biometric characteristics, religious beliefs, specially designated status, medical health, financial accounts, individual location tracking, and the personal information of children under 14.

Legal bases and consent

Where we do not rely on any other legal basis provided under the PIPL, we will obtain your consent to process your personal data in order to:   

  • fulfill a contract you will or have entered into with us;
  • fulfill statutory duties or statutory obligations; or
  • respond to a public health emergency or to protect your life, health, and property.

We may process your personal data if it has already been lawfully made public, provided that the processing is within a reasonable scope and complies with the PIPL. We may also process your data under other circumstances as permitted or required by applicable laws and regulations.

Consent

We  will obtain your separate consent if:

  • We collect your sensitive personal data;
  • We share your personal data with third parties acting as data handlers;
  • We transfer your personal data to recipients outside of Mainland China; or
  • We use image or identification information collected in public spaces for other purposes than to maintain public security.

You have the right to withdraw your consent. You can find more information on this in the “Your Rights” section in the Main Privacy Notice.

International Transfers

As Ericsson operates globally, we may transfer, access, store, or otherwise process your personal data outside of Mainland China where necessary for business purposes, provided that adequate protections are in place to protect the integrity and security of your personal data. When your personal data is transferred outside of Mainland China, we will ensure that such transfers comply with applicable Chinese law.   

Your rights

In addition to the rights you can find described under ‘Your rights’ in the main Privacy Notice, the PIPL also provides the following right.  

Rights for next of kin: If you are the next of kin of a deceased individual whose personal data we process, you may exercise rights such as right to access, correct, and erase in respect of that personal data for your lawful and legitimate interests, unless the deceased arranged otherwise before their death.
