Cross-border data flows

Data should be able to flow by default. Any limitation to cross border data flows should be limited to clearly defined exceptions in line with WTO principles such as GATS Article 14.

Intent, e.g. the illicit circumvention of privacy standards should not be confused with the means used for transferring data. Given the large variety of types of data transfer, “one size fits all” transfer definitions should be avoided. Securing predictable rules for open international data transfers through multi-lateral trade agreements is the ultimate goal.
